Terms & Conditions – Drive Solo Driving School (WA)

In these terms and conditions, “we”, “us” and “our” refer to Drive Solo Driving School, the owner of drivesolo.com.au (“the Site”). “You” refers to any person using the Site or booking our driving lessons in Western Australia.
Please read these terms carefully before using the Site or booking a lesson. By using this website or purchasing a service from us, you agree to be bound by these terms. If you do not agree, please do not use this website.
We may update these terms at any time by posting changes on this page. Your continued use of the Site after changes are posted means you accept those changes, so please check this page from time to time.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), as applied in Western Australia by the Fair Trading Act 2010 (WA), that cannot lawfully be excluded.
General Conditions
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss or damage arising out of, or connected with, the use or performance of our services. We are not liable for delays or failures caused by events beyond our reasonable control, including incorrect email addresses, internet or equipment failures, or the non-performance of third parties.
You must not use our website or services for any illegal or unauthorised purpose, or in a way that breaches any law that applies in Western Australia or your jurisdiction (including copyright law).
Intellectual Property
All material on this Site — including the design, layout, graphics and overall appearance — is owned by or licensed to Drive Solo Driving School and is protected under the Copyright Act 1968 (Cth). You may not reproduce or redistribute any content except as follows:
- You may print or download content for personal, non-commercial use.
- You may share content with individual third parties for their personal use, provided you acknowledge drivesolo.com.au as the source.
- You must not reproduce, distribute or commercially exploit any content without our express written authorisation.
- You must not transmit or store our content on any other website or digital retrieval system.
Services will only commence once payment has been received and you have provided all information we reasonably require.
Prices and Changes to Our Services
Prices for our lessons and packages may change without notice. We may modify or discontinue any part of our services at any time. Where you have already paid for a service, you will always receive the service you paid for, a suitable replacement, or a refund in accordance with the Australian Consumer Law.
Services Disclaimer
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Subject to those guarantees, we do not warrant that your use of the Site will be uninterrupted, timely, secure or error-free, and the Site is provided “as is” and “as available”.
These terms, together with any policies posted on this Site, form the entire agreement between you and us and replace any earlier agreements or communications.
Vehicle Liability
If you use one of our vehicles for your Practical Driving Assessment (PDA) with a Department of Transport (WA) assessor and your instructor is not in the vehicle, you are responsible for the lower of the repair cost or the applicable insurance excess if the vehicle is damaged.
If you use our vehicle during a supervised lesson, you are only responsible for the lower of the repair cost or the insurance excess if you failed to follow your instructor’s directions and this caused the damage.
If your intentional, reckless or careless actions damage our vehicles or any other property, you are liable for the lower of the repair cost or the applicable insurance excess.
You are responsible for any traffic infringement notices you incur under the Road Traffic Act 1974 (WA) and related regulations while driving our vehicle.
Booking Driving Lessons
Lessons can be paid for in cash at the lesson, by bank transfer, or by credit card when booking online. Bookings made directly with an instructor are only confirmed once you receive a confirmation email or text message.
Each lesson includes both on-road and off-road time, including briefing and de-briefing, so your instructor can give you information specific to that lesson. Lessons start at the pre-arranged pick-up location unless you have agreed otherwise with your instructor.
Licence Status
By booking or starting a lesson, you confirm that your learner’s permit or driver’s licence is current and that you have no disqualification, cancellation, suspension, pending charge or appeal relating to driving offences in Western Australia or elsewhere.
You must bring your current learner’s permit (or licence) and your learner log book (paper log book or Learn&Log via the ServiceWA app) to every lesson. If you do not have your current permit or licence with you, the lesson cannot proceed and the full lesson fee is payable.
Cancellations and Changes to Bookings
We require a minimum of 24 hours’ notice to cancel or change a scheduled lesson.
When you book a lesson, we reserve an instructor and a vehicle exclusively for you, which prevents other students from booking that time. A late cancellation means your instructor cannot re-book that time slot.
You can cancel or reschedule by phone, text message, email or Facebook Messenger. If you cancel with less than 24 hours’ notice, or you are not available at the lesson time, the full lesson fee is payable.
Late Arrival and No-Shows
If you are late for a lesson, you may only use the remaining lesson time, and the full lesson fee still applies.
If you are more than 20 minutes late without contacting us, or you do not attend your lesson at all, we may cancel the lesson and charge the full lesson fee.
Our commitment to you: a clean, modern vehicle and a professional instructor who arrives on time for your allocated lesson.
Cancellation of Lessons by Drive Solo Driving School
Our instructors do everything possible to start and finish lessons on time. If your instructor is running behind schedule, we will notify you and either extend the lesson or credit the lost time to your next lesson.
We may cancel, postpone or change a lesson in certain circumstances (for example, instructor illness or dangerous weather). If we postpone or reschedule, any fees paid will be carried forward to your next lesson or refunded at your request.
Your instructor may end a lesson immediately, with the lesson fee still payable, if they reasonably suspect you are affected by alcohol, drugs or any condition that impairs safe driving, or if you drive dangerously or ignore the instructor’s directions in a way that endangers the public.
Refund Policy
All prepaid lessons and packages are valid for 6 months from purchase. During peak periods (such as Christmas and school holidays) lesson times may be limited.
If we cannot provide your packaged lessons within a reasonable time, you may request a refund. The refund is the original package price, less any lessons already provided (charged at the full hourly rate), less 25% of the remaining balance to cover administration costs.
This policy does not limit your rights under the Australian Consumer Law. If our services fail to meet a consumer guarantee, you may be entitled to a remedy — including a refund — regardless of this policy. Unpaid fees may be recovered through the Magistrates Court of Western Australia (minor cases division).
Photos on Social Media
When students pass their Practical Driving Assessment, we love to celebrate by sharing their photo on Facebook and Instagram. If you do not want your photo published, simply let your instructor know — no photo will be taken or shared without your consent.
